Is the dentist permitted to delegate procedures to the auxillary staff within the scope of their practice? Why wouldn’t chairside bleaching under direct or indirect supervison fall in this catagory?

Yes, the dentist is permitted to delegate procedures to auxillary staff within their scope of practice. However, the Florida Board of Dentistry doesn’t think
this particular procedure is within the scope of practice for dental hygienists or dental assistants.

I have been offered the opportunity to purchase a teeth whitening system that uses light and peroxide to whiten teeth. I had the procedure done on me, and was pleasantly suprised by the results. I am interested in purchasing this system to use in various outlets for consumers, but I am hearing conflicting reports as to whether or not a license is required to perform this procedure. The individual who treated me was not licensed, and I am aware of certain spas, and tanning salons that have added this teeth whitening procedure to their list of services they offer, again without the person who is performing the treatment being licensed. Is this legal in Florida? A low level 9% peroxide solution is being used in the treatment, which seems non-invasive, but I certainly do not want to participate in what may be an illegal practice. Accurate input, or advice on where to find out for sure would be appreciated. Thank you, Don
